By accessing or using our websites, products, or services, you agree to be bound by these Terms & Conditions, including our Privacy Policy (https://robertnoakes.com/privacy-policy/).
These Terms & Conditions affect your legal rights and obligations. If you do not agree to be bound by all of these Terms & Conditions, do not access or use our websites, products, or services.
Users of our websites, products, and services must be above the age of 13.
1. License
Our products are licensed under the current version of the GNU General Public License (GPL) (http://www.gnu.org/licenses/gpl.html).
As a license holder of our products, you cannot distribute, freely give away, or resell your license keys. You may not transfer the license keys to a new owner.
You must use your license keys on websites that you own or manage. You may use your license keys on a client website in situations in which you maintain an ongoing relationship with your client as a consultant. By using your license keys on a client website, you acknowledge and agree that your client does not have access to backend code and will come to you for support.
Any third-party libraries in our products are subject to their own licensing. You are responsible for reviewing and following third-party licenses, terms, and conditions. You may not bundle our products with a web hosting package.
2. Payments and Price Changes
When you purchase a product, you are actually purchasing a subscription to that product with RobertNoakes.com, which gives you access to product downloads, updates and support for a period of one year following the date of purchase.
Each product that you purchase will have its own subscription and license key. Each product subscription you purchase is due for renewal one year from the date of purchase.
Products purchased on March 30, 2018 or later renew automatically unless you turn off that option on your My Account page. If your subscription auto-renews and you want to cancel, no refunds will be given.
RobertNoakes.com reserves the right to modify or discontinue, temporarily or permanently, prices of all products or subscriptions, including annual subscription fees, at any time with or without notice. Such notice may be provided at any time by posting the changes to these Terms & Conditions. All prices are in U.S. dollars.
3. Refund Policy
When you purchase a subscription to our products, you are able to download full working versions of our products. For this reason, we are unable to provide refunds for any subscriptions purchased on our site. Free versions of our products are available on the WordPress Plugin repository (https://wordpress.org/plugins/), though these versions don’t contain the same functionality as the product subscriptions on this site.
4. Product Updates and Support
Product updates are released as often as needed for bug fixes, compatibility, or feature additions.
Online support is offered through a help desk system. We do not offer phone support, nor do we offer support or otherwise for the installation, customization or administration of WordPress itself or third-party applications.
Our products continue to function if your subscription expires, but you lose the ability to download product files and updates or get support. If your subscription for a product has expired, in order to download a product/update or submit a support ticket you must renew your annual subscription to that product, regardless of the situation or circumstance. A lapsed subscription that is renewed starts from the date you purchase it, but there are no discounts that may be applied to the renewal cost.
5. Newsletter and Email
By purchasing our products, you agree to be signed up for our newsletter, which will be sent to you occasionally to announce new releases, updates, or other news. You are free to opt-out at any time by clicking on the unsubscribe link provided in the newsletter. We do not give your personal information to any third-party companies, as mentioned in our Privacy Policy.
RobertNoakes.com may on occasion send you email notifications related to your plugin licenses. These transactional emails may include notification of licensing changes, changes to our Terms & Conditions, license expiration notices or other transactional emails related to your purchases. You cannot unsubscribe from these account notices.
6. Ownership
All of our products, with the exception of any third-party components contained in the products, are the property of RobertNoakes.com. You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified.
7. Termination and Cancellations
RobertNoakes.com, in its sole discretion, has the right to suspend or terminate your account for violation of the Terms & Conditions and refuse any and all current or future use of the service or products provided by us. Termination will result in the deactivation or deletion of your account and access to your account, including the deactivation or deletion of all content in your account.
RobertNoakes.com reserves the right to refuse services or products to anyone for any reason at any time and terminate your account if deemed necessary.
If you are dissatisfied with any aspect of our services or products and wish to terminate your account voluntarily, you may do so by contacting us, but no refund will be provided. When you voluntarily terminate your account, we will deactivate and delete it and all content contained in it.
8. Warranty and Liability
We guarantee our products to function as advertised when installed on a clean, self-hosted installation of WordPress and when activated without any changes. We cannot guarantee our products will function with all third-party components, themes, plugins or web browsers.
Beyond this guarantee, we provide our products “as-is” without warranty of any kind, expressed or implied. We shall not be liable for any damages, including but not limited to direct, indirect, special, incidental or consequential damages or losses that occur out of the use or inability to use our products.
RobertNoakes.com’s aggregate liability under or in connection with the Terms & Conditions will be limited to the amount paid for the services or products, if any. This limitation will apply even in the event of a fundamental or material breach of these Terms & Conditions.
9. Indemnity
You agree to indemnify and hold RobertNoakes.com, officers, directors, employees and agents, harmless from any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from content you submit, post, transmit or otherwise make available through use of our services or products, your connection to our services or products, your violation of the Terms & Conditions, or your violation of any rights of another.
